First time getting burned by another collector :(First time getting burned by another collector :(Diary

Honestly, I just need to vent. I am beyond upset right now, and am learning that regardless if you think someone is your friend or not, well you shouldn't bother trusting anyone. I spoke to this person for I would say maybe a few months prior to this incident, and I genuinely considered him a friend, we talked about grails and wishlists, upcoming orders and all that. He told me about how he once got scammed and I told him he should fight to get his money back but he said it wasn't worth the effort.

I guess I should have paid closer attention to how weird that sounded. Well eventually we spoke again as he was interested in one of my figures, we worked out a trade. We were each ready to ship and I ship mine but he didn't ship his, he chose to cancel as the circumstances changed. I understood and accepted the cancellation, just asked him to ship back my figure at his earliest convenience.

I was still interested in his figure and still offered to purchase it at his valued estimate, and he agreed and I was quite happy about this.

And since I trusted this person, assumed we were friends. I foolishly paid using PP Friend and Family, he did ship my figure and it did arrive. It had some scuffs and damage not mentioned but in the end that was okay with me.

I asked him to ship at his earliest convenience and since we used Mercari to handle the shipping, all he needed to do was submit a return request for free return shipping. But he didn't pay attention and just accepted and rated me.

He messed up so he was okay with covering the return shipping (only $10) but yeah he got busy. Apparently so busy, that printing a return slip and post office run was not possible for a whole month...

I was asking each week, he was getting more and more annoyed. Snapped back at me if I dared ask, I felt bad when I asked him about my figure. Eventually he got really rude, honestly he was being kind of a d**k. But he had my figure so I continued to be nice, I decided enough is enough and threatened to work with Paypal to chargeback his account, he got extremely offended by this and he said some very rude things.

We communicated on ig, so he would see my posts every once in a while and he really said to me in that moment that "I'm busy unlike you showing your tits for attention"

I was so offended by this, not because I was offended by the comment regarding showing off my body, (PS I think even if you do show off your body you should still be respected and treated fairly) I'm just shocked he would say this with what I had posted which was a gym selfie??? Like, the audacity. Who says this... this is some real incel energy right here.

Well I was mad, he deleted this message and I'm so mad because I really wanted to screenshot it, he was super rude but he said he would ship Monday. I said if he didn't ship Monday I'll talk with Paypal.

Well, today is Monday... lucky me.

I messaged him last night, he always sees my messages like within minutes. So he didn't see it, I messaged this morning, nothing, this afternoon, nothing.

I reached out to him on mercari, I changed my username and profile picture so he didn't realize it was me. I had paid for shipping on mercari and asked him if he shipped, he said yup just waiting for UPS to confirm. This was odd, he hadn't responded this nice since the trade. I explain that I want a receipt and picture of tracking id on ig. He starts to realize it's me and says he hasn't shipped.

I said then why did he say he did? And it's because he asked his buddy to ship something for him, so this whole time he's been making excuses for what?

He refunded the listing and blocks me on mercari and instagram. Ooh I am fuming, and am trying to get my money back as we speak.

But let this be a lesson to everyone... friends aren't friends :/

I'll make an update once I make more strides against him, I'm genuinely thinking of suing. I have his full name, email, and address. Am I this petty for what maybe around $350 ? Honestly, after the way he treated me, I think so.

Is it my fault for allowing someone to manipulate me? I guess so...

And with that I will go cry as I report him on the anime figure subreddit, on Our Figure Collection discord, try to get him banned on Mercari or Paypal. I am beyond upset.

UPDATE:

I got him banned from the Reddit, I reported him on mercari, reported him on PayPal, I also opened up an internet crime report against him.

I couldn’t get a refund via PayPal, eventually I just decided to do a charge back with my bank. It went through and I got the reversal. So now my only loss is the difference in value between the figure I traded him and the one I bought from him. This is still better to me then me just sending my figure to him for free so I’m okay with this resolution. Oh boy, I can only wish Karma can pay him a visit.

Jenthehen20 days ago#101921192Yeah, check out the real deal story of the McDonald's hot coffee case (the most famous example of big company smear campaign trying to assert that a lawsuit was "ridiculous" when it wasn't at all!)
Oh yeh. I'm familiar with that one. It's hard not to be.

True. I suppose you could really spin the story either way with the right convincing.

FALprofessional20 days ago#101919882Wow. That is an extremely interesting point, and perhaps that is the case. It makes complete business sense. I'll admit, I can't be bothered to keep up with the ins-and-outs of legal affairs. I am but a sheep of the herd, apparently.
I guess your profession is in law, given your original comment, your reply here, and the casual "Otaku at Law" tag. I'll give it some good consideration. I still don't think it'd be a very worthwhile pursuit, though. Especially based on the cost breakdown you provided in your own comment. Thanks for replying to give me a different perspective, at the very least.

Jenthehen20 days ago#101917137Can't resist piping up, but people are NOT actually way too litigious - big companies have put a lot of effort into propaganda to make the public THINK there are way too many frivolous lawsuits in order to avoid liability (and shame/repercussions in the court of public opinion).

FALprofessional22 days ago#101832588It was probably said in the heat of the moment, but do not sue. Especially not simply over a figure. People are already way to litigious.
The situation is a shame, though.

It would cost you more than is worth it in filing fees (probably around $50 in small claims) and other miscellaneous expenses (travel to where he lives for a court date, printing copies of evidence, and just general effort and aggravation) to sue to try and get $350 back.

Friends and Family transactions SHOULD be an acceptable way to avoid fees and tax implications in this hobby, and I'm sickened to keep seeing assholes ruin the option by being dishonest jerks.

I'm sorry you got screwed over. The best way to approach online trades or transactions with less protections is to only do it where you're willing to take the risk of losing the figure/money without it totally ruining you.

EmilyC122321 days ago#101873394(Side note) Hi! sorry I was scrolling through and noticed your comment about paypal balance, what does this mean if she had used her balance? Currently I have my balance set up aside from my checking account so I can budget for preorders and purchases but should I reconsider an alternative option?

as long as you as paying goods and services it doesnt not matter if you use your balance or draw from your account/card.
However if you’re ever scammed after paying friends & family (thus no protection through paypal) your last line of defense is claiming the payment directly with your bank, however this is only possible if you didnt pay with your balance (you cant contest the transaction with your bank if the transaction never hit your bank account)
hope that helps! what you’re doing seems fine!
